is there a time limit to file a probate in florida after a family members death

It should be filed as soon as possible, but it can be filed years later. there is not statute of limitations on filing.

A will is supposed to be deposited with the court within 10 days of the death, but many times that is not done. There is no penalty for not doing so. If it has been longer than 2 years, you can petition for a Summary Administration.
