Legal Question in Wills and Trusts in Florida

wills and estates

I am sole heir and personal representative for my moms estate. It's only me and my dad. When the order comes thru to get into the safety deposit box- do I go into the box or will there be someone assigned to go thru it with me.

Every bank that I have dealt with will require you to set an appointment and meet with an officer or representative of the bank. If you have a key, you will go to the box and open it with the officer and then to a private room to make an inventory of the box's contents which the bank representative will write. Without a key, a locksmith will have to be present to drill the box in your presence. The same procedure for the inventory will then be conducted.

You will then need to go back to the court with your copy of the inventory and have a motion prepared to remove the contents. Upon receipt of the order from the court, you will need to obtain a certified copy of the Order and bring it with you to the bank in order to be able to remove the contents of the box.

Re: wills and estates

typically, it's just you. If he is able, you might take your dad go with you just to avoid any potential family discord (unless you expect something in the box that your dad should not see).
