Legal Question in Workers Comp in Florida

Over Worked

I have a note from my workcomp Doctor limiting my hours to only 40 hours a week. My employer has had this letter for the past 8 weeks and my employer has yet to comply. My employer is working me on a range of 44 to 52 hours a week. When I ask if I my leave I told I need to say a little longer. I have also missed a Doctors appt. because I was told I had to finish with a customer first. Can they do that?

In a perfect world, the Employer is supposed to comply with the doctor's instructions. However, we who work in the workers' compensation field knows that this does not always happen. If your employer is not complying with the doctor's restrictions, and you are informing the Employer of these restrictions, you need to go back to the doctor, and let the doctor know of your Employer's noncompliance. You need to document with the doctor, and make sure the doctor documents the same in his records, this noncompliance. If this continues, you need to seek a competent and experienced workers' compensation attorney immediately.
