Layed off after being told job is safe

My husband and I had the same employer. There was a

layoff in Dec. After the layoff the president called

a company meeting and said everyone at the meeting had a job. My husband was paid untill Jan. 11. On

Jan.9,2002 he had heart surgery. On Jan.16 his em-ployer gave me his layoff notice. Is this legal? I

was part of the Dec. layoff. Where do I look for help?

There are far too many factors involved in this situation to be able to tell if you have a case. For example, if your husband was told that his job was safe in December, had heart surgery in January, and was then laid off a week later, there might be a claim that he was discriminated against because of a disability. However, if he was already on a list to be laid off prior to the company knowing about his heart surgery, it would not be discrimination. You may file a charge with the EEOC for disability discrimination and let them investigate the case or consult with an attorney to see if you might have a case. Good luck.
