Legal Question in Bankruptcy in Georgia

my daughter had her car repoed which we were jointed signed for, she is planning to file chapter 7. will they be able to garnish me for the balance if it is included in the chap ?

Her bankruptcy filing does not get you out of the debt, so yes they will likely come after you for the amount owed on the loan after the sale of the car at auction (for a very low amount).

I echo the comments by the other practitioners. If you jointly signed, then you too are responsible for payment for the debt. Although it does not happen often, you could enter into an arrangement with the finance company regarding the underlying debt. Before you communicate further with the repo company, Finance Company, etc. you should hire an attorney to represent your interests.
