Legal Question in Bankruptcy in Georgia

We need a "Motion for Release" filed in Hall County to recover a piece of property that we had owner financed with a gentleman that has now filed Bankrupcy. The Bankrupcy court did not include the property in the Bankrupcy because the guy owed too much money on it, but it does not just automatically revert back to us we are being told.

What is your question? From your post, you need a lawyer in the Bankruptcy case. There is no "Motion for Release" and there is no "included" or "not included" in a Bankruptcy case.

As both lawyers noted, there is no such thing. Get a lawyer before you inadvertantly commit contempt of the bankruptcy court, which could result in loss of yoiur claim and huge monetary sanctions.

ALL debt a person has and ALL property a debtor owns are part of the bankruptcy estate and under court control and you cannot do anything to them without a bankruptcy judge lifting a stay after an appropriate motion and hearing.

Again, get a lawyer ASAP.
