Legal Question in Bankruptcy in Georgia

My wife is thinking about filing bankruptcy -Chapter 7. This would be based on about six credit cards she can not repay. These cards each are in her name only. Our home is in my name only and has been 10 years before we were married. We have separate checking accounts, credit card accounts auto loans, charge accounts and IRAs. Could I be completely left out of her Chapter 7?

There is no easy answer based on a few sentences, and we don't know what "left out" means to you. The only way to find out is to see a Bankruptcy lawyer, since she would have to do that anyway.

To give you a general answer, she can file without you. She will have to list some information about you (including your income and expenses) even if you do not file. But you can stay out of her case even though she'll need information from you.
