If an IT tech is on a contract and makes $35/hour are they entitled to time and a half once they pass 40 hours per week? State of Ga

What type of contract? Is the tech an employee or a contractor. Re-post withmore details.

If they are an independent contractor, the overtime rules do not apply. However, there are specific factors which determine whether a person is an independent contractor or not, and just because they are called an independent contract does not mean that is what they are.
