If my father has just received lawsuit money but didn't get a chance to cash the checks before he deceased, can they be cash by the next of kin for his burial arrangements?

No unless the next of kin has been appointed as personal representative of the estate and deposits the funds into the estate bank account and then uses the funds to pay for your decease father's expenses including burial.

And this is a probate issue not a civil rights issue.
