Legal Question in Technology Law in Georgia

Re: Sell of personal computer

I sold a computer to an individual for $400 which was a great deal as it was brand new. She paid me $200 about 7 weeks ago and was to pay me the other $200 about 5 weeks ago. Now she says she will not have the money for a while and will only give me the computer back if I refund her the $200. Do I have to give her the $200 back as she defaulted, not me. Also, it seems to me it would almost seem stolen as she did not pay.

Re: Re: Sell of personal computer

You do not have to give the computer back and may go after the buyer for the remaining $200. Due to the small amount involved, you should probably try and work it out with the buyer, e.g. payment plan. If that is not possible, take her to magistrate (small claims) court.
