construction bid thief?

recently handed in some plans that was going to be bidded on a multi-million dollar construction job for a take off on materials. The salesman went over our head and went straight to the owner with prices. We make marginal profit on material mark up. In other words our trusted sales man stole our lead which possibly cost us substantial amount of money. illegal?

A few questions. Why is the salesman a "thief" and what was stolen? On what basis do you believe that this salesperson was legally or contractually obligated to deal only through you? Was there a confidentiality agreement protecting this "lead?" You can't really sum up a multi-million dollar deal in two sentences, but maybe you are asking if it is "illegal" for an independent sales person to look for a better deal. The general answer is that it is no more "illegal" than the contractor finding a better deal from another salesperson. Getting beat in a business deal is not "illegal." If you believe there is more to the story, or there are contracats or other duties involved, you need to a see a lawyer given the amount of money that appears to be at issue.
