Legal Question in Construction Law in Georgia

Mechanics liens while building home

We have had liens placed on a home we are building. We paid the builder he didn't pay the suppliers.

We are trying to close on our loan. We have been told to try to get a bond-is this the right thing to do or should we pay the liens and then sue the builder. The builder operates out of an LLC which doesn't own any property except maybe some equip. Any prop he owned personally has been quick claimed to his father. Help!!!!!!!Also, is this theft by conversion? This is in Fannin county (blueridge GA)

Re: Mechanics liens while building home

It sounds like you now have two agendas to accomplish--recovering your lost funds and completing your home purchase. The methods that need to be utilized operate independently. You need to arrange for a consultation with an attorney in an effort to limit your potential for loss and maximize your ability to recover.
