Legal Question in Construction Law in Georgia

How to put a lein on a home.

We had a contract to install countertops in a home and finished the job, homeowner satisfied with work. Now we are having a difficult time getting paid. She said it is a bank disbursement loan and after the bank inspects the job they would send out the check. She told us this would take about 1-2 weeks. It has been a month now. What are our options? Should we call the bank, can we put a lein on the home, and how do we do this with out hiring a lawyer? Please let me know if you have any suggestions.

Yes, you can probably do liens without a lawyer but obviously you have to know how. Guiding you through it is far beyond the scope of this site. There are strict time limits. Perhaps having a lawyer handle it this time will give you the knowledge to file on your own in the future. Alternatively, you might be able to sue in small claims court if the debt is under the limit.

You probably have the right to place a lien, but no one can guide you through it without being retained. If you really don't want to hire an attorney, file a claim in magistrate (small claims) court as long as the total claim is $15,000.00 or less. Otherwise, have an attorney write a demand letter - it is inexpensive and often gets results.
