Motorcycle Financing Issues

In June, I visited a Motorcycle dealership, and using a motorcycle manufacturer credit card account, I purchased a motorcycle and accessories totaling $7000. I was issued the title in my name without a lien. I came to find out that the dealer issued a full credit to the credit card account 7 days after the purchase (6/12/02). I figured I would be charged again. In mid August, I called the credit card issuer to close the account as I did not need it any longer. I received a confirmation letter stating that I had a zero balance and the account was closed. On 08/31/02, I received a call from the dealer demanding I return the bike that day, or they would have me arrested. I of course returned the bike. Now, they want me to give them all of the paperwork as well as paying them an unstated additional amount of money to cover the depreciation. Can I be arrested over any of this? Do I owe them any additional money if the bike is returned? Would that amount be affected by the fact that they took 3 months to let me know there was a problem? Is this the same kind of situation as if an automobile's financing falls through? Since they issued a full credit, and I have a no lien title and bill of sale, do they have any right to the bike?

Re: Motorcycle Financing Issues

Based on what you wrote, I would have never advised you to return the bike. However, since the threat of an arrest is never a pleasant experience, I would advise you to contact a local attorney. It appears that there are many issues that need to be dealt with in person rather than in this type of forum.
