Legal Question in Credit and Debt Law in Georgia

Paid original creditor, collection agency worked on a percentage basis never collected from me nor did they own the debt. How is the collection agency able to report it as a paid collection. The Settlement Agreement with the three major credit reporting agencies (CRAs) � TransUnion, Equifax, and Experian (the �CRAs�). states the following, CRAs will no longer report debt that �did not arise from any contract or agreement to pay which this was an overdrawn checking account.

You had a contract with your bank concerning your bank account and liability for overdrafts. The collector had an assignment or contract for the debt and it is normally them who reports to credit bureaus as part of their services.

Is the information accurate? That is all that matters. Evidently this account was a collection and was paid after. So its reported correctly. I don't know what the rest of your post refers to. You are quoting something but not putting forth all of the information. It sounds like you are taking a statement t at applied to one thing and trying to twist it into something else to make the reporting of your information seem wrong.

No lawyer on a public bulletin board can possibly answer your question without seeing your credit report and knowing what was reported and by whom and why. Bottom line - if you think the account was reported wrong, then you dispute under the FCRA. You first dispute with the credit bureaus by certified mail. Then you dispute with the collection agency or creditor who reported the debt. However, if the information is correct, then it can stay on your report regardless if it is derogatory.

Do you need credit? If not, then I am not sure why you are worrying about it. There are things you can do to boos your credit score. Paying your bills on time and having a mix of credit (retail and installment accounts) and having a long payment history all helps.
