Legal Question in Criminal Law in Georgia

My 24 year old relative was arrested on two felony charges of marijuana and a misdemeanor. He does not smoke nor sell drugs, but the young man who he was visiting obviously smoked marijuana since some were found in his pocket when the narcs raided the house. The dogs found marijuana in a vacant house next door, but they took everybody to jail even though my relative tested negative for drugs and had no drugs on him. He also had no knowledge of any drug dealing there. The other guy pled guilty and got some years in prison but my relative is pled not guilty and hasn't gone to trial yet. Meanwhile he applied for a good job, passed tests and interview but when background check came back, it showed he was convicted and sentenced to probation. Oh by the way he has no criminal record and has been in the military. How can someone receive a conviction without a trial and already have that information available for prospective employers.

It might be that what the potential employer's investigation showed was the arrest record or the clerk incorrectly reported that information.

Either way, your relative needs to hire a criminal attorney for the criminal charges and to correct the record ASAP
