Legal Question in Criminal Law in Georgia

I was arrested during my first appearance in court for theft by deception from Walmart a month after I got fired from Walmart for this so called theft. The supervision over loss prevention said that I stole from Walmart. I never conceal any of there items our took anything from the store intentionally. I was rang up by a another employee that was working at Walmart and she didn't ring up all my items but placed them all in the bag. I was called in the office approximately a month after it happen and that cashier was fired for stealing takeing money and under ringing of a amount around 1000. Dollars. The supervision said I knew the cashier wasn't ringing all of my items up and that I was stealing because I took those items knowing that they weren't paid for. I told him I didn't know that she had done that until she got fired and had called me and told me that she had hooked me up one time going thru here line for all the free rides I gave her home and that she didnt know f they where going to call me in the office about it our not. So I asked how long ago it was when she had done that. She said that she had done about 3 weeks ago. I told her I wasn't worried about it because that was over a month ago. Well sure enough a month went by since she had got fired and they called me in the office. I sat in a chair and the man asked me why I taught I was in here. I thaught it was for my attendance because I had totally forgot about the whole thing about her not ringing all my stuff up. He said nope it's not for attendance and told me he was over loss prevention and asked me again why I think I'm in this room and that he wanted me to tell the whole truth and that I wouldn't get arrested today. I told him I didn't know what he was talking about but why should I be getting arrested because I never stole anything from Walmart. He told me he had me on camera coming thru the cashiers line and her under ringing my items and me leaving the store with those items. I told dont remember any such thing like that. He recalled my order and asked me again if I knew that she didnt ring up my items. I told him that when my items where getting rung up I didn't know the cashier was under ringing my stuff. Me and her where friends and she called me about 3 weeks after she did when she got fired and told me she had hooked me up one time and she wasn't sure wether or not y'all knew about it but. I told him I couldn't remember what all the items where that I had bought when she had told me so that's why I didn't try to come back and pay for them because it happen so long before I found out she did that. He said thats no excuse that I was stealing and I knew what she was doing and I might have to be walked out in hand cuffs the choice is mine if I want to leave now I can walk out the door if I like. Then he asked me if there's anything else he should know to keep me from going to jail and not losing your job that he might can talk to his boss about I told him that I felt sorry for the other girl because she was going thru hard times and she was a single mother and that I taught she had been stealing because when I was at work she would always ask me to bring her personal hygiene items back to her register and I never seen here pay for them. Then the suppervisior told me to write that on the paper and I did. Then he told me to write down on the paper anything I would to say to the district manager over Walmart and I also wrote that I was sorry for anything I had done wrong and I would pay for anything that Walmart lost due to me and I would really like to keep my job. Then he asked how much I thaught my order was I said I guess it was about 60 dollars. So they charged for 60 dollars worth of theft and it turned out the whole total of everything added up together from my order was less than 60 dollars and some of the items they charged me for where paid for.

Well that's every thing far as my case. So I went to court again to today to put in my plea and I plead not guilty and asked for a jury trial. So what are my chances and what do u think I should do from here?

If the jury finds me not guilty can the judge still convict or charge me with anything.

I did not read it all, because it looks like you want to give your version of the story and somehow get an opinion on whether you win. If you want a good result, hire a good criminal lawyer. Without a lawyer, your chances are far worse, whatever your story is.

If the jury says NOT GUILTY, you go home, end of story. IF the jury says GUILTY, then you are looking at few days in jail followed by probation for 12 months and community service a fine and a conviction that will follow you for the rest of your life. It ws extremely foolish to post that lengthy account on the internet like you just did where prosecutors and police can see it and potentially use it against you. With that much detail, they know who posted it. It was also extremely foolish to go to court with no lawyer. As for a jury trial, do you know how to voir dire, to do a Brady motion, to file appropriate motions in limine and other motions, to draft requests to charge, to cross examine witnesses, to subpoena witnesses, etc. If you don't you should have hired a lawyer long ago. Do that in the morning.

What happens when and if you are found guilty? You likely spend at least a short time in jail and owe fines and get probation. But more importantly, you will carry a theft record for life and will be essentially unemployable ever.

Again, do NOT delay. You desperately need a lawyer.
