Legal Question in Criminal Law in Georgia

A couple years ago a friend of mine got into some trouble. Was fined 5,000 + 8 yrs probation. First offender. always called in on time,payed what he could monthly. A couple more yrs go by. He gets into trouble again. We hired a lawyer, he told us that he has to go back to the first case because it was still going on. He charged 7,500 for the first case, plus 7,500 for this new one. Was he correct in charging us again for the first offence?

Going back to the first case ("FOA case") was probably to prevent an adjudication of guilt on the first offender charge

But you did not give enough information (i.e., how much time left on his FOA case??)
