The short answer is it depends. The chances of conviction and incarceration are, in most cases, tied to the amount of evidence against the person, the person's history, and the discretion of the judge at the sentencing phase. I hope you have a lawyer. If not, make that your first priority. If so, you should direct future questions to him/her.

It depends on the facts of the case.

It also depends on how quickly you get him a good lawyer. If you have waited to get him one, do that TODAY. The longer he goes without counsel, the higher the risk of a bad outcome.

He may go to jail. It depends on his record, the prosecutor, the judge and other factors. See website for how pleas are constructed: www.lawrencelewispc.com
