Legal Question in DUI Law in Georgia

I was hit by a drunk driver, what can I do about it?

On November 19th, 2001 at 8:00 am, on my way to work, a Pickup Truck came into my lane and hit me head-on, in my Honda Civic, going 45-50 mph. My car was totalled, the male driver was uninsured and drunk. We were taken in the same ambulance to the emergency room. The man was arrested.I retained a lawyer Nov. 29th, 2001. I was badly bruised in both knees and chest, nothing broken. I went to an orthapedic surgeon who instructed me to have physical therapy 4 days a week. Due to my work schedule and co-pay costs, I was unable to full fill my therapy duties. For which my attorney has said, ruined my case. Now my attorney will not even return my phone calls and an entire year has passed, wasted to waiting and trusting this lawyer. I haven't even been re-paid for my medical costs, much less benn able to replace my car! Isn't there anything I can do about this? Can I file a civil suit against this man who hit me? Or has too musch time passed? Thank You. Mary A. Bailey

Very complex question. Let me suggest some elements that would make up a good part of the answer. 1. You should hire a lawyer who is familiar in this area of law. 2. You should contact your insurance company to make sure you have uninsured motorist coverage if the DD did not have insurance. You can sue for your losses and damages. You can cause the DD license to be suspended until he pays your adjudicated damages if he is proven to be at fault in the collision. Some of these areas are overlapping in different, but related areas of law. Let us know if we can be of greater assistance. E.H. Young, 706-724-8554 (Augusta) 236-4384 (Savannah)
