Legal Question in DUI Law in Georgia

underage consumption

I was not the driver in the car but we were stopped at a road block and the officer asked if we had been drinking. We said yes. The driver was given a breathalizer and passed. The other passenger and I were not given a breatalizer. I am 20 years old. Is it absolutely necessary that i hire a lawyer. and also i was reading my ticket the other day and noticed that my birthdate was wrong. According to my ticket I was born in 1982 when really it is 1983, so accoording to my ticket I am 21. I heard that if there is anything wrong on the ticket the case will be thrown out is this true?

Depending on your record, you might be facing only a fine. However, in view of the defects on the ticket, I would recommend you consulting with an attorney. It is correct that defects in the charging instrument can be fatal to the case, but I don't think so in your situation.
