Legal Question in Family Law in Georgia

My 13 year old step daughter, who has lived with her mother since her parents divorce, has told her dad that she wants to come and live with us. Her mother is understandably upset, but is also being unreasonable. She has said that she will make the court battle so messy that we won't be able to afford it. We both live in Georgia, and my husband has been true in paying child support, and in visitation. She comes every other weekend and then some, when the school schedule allows, so it is not like we are strangers. This is also something that my step daughter has given a lot of thought to. It is not being made on a whim. My question to you is, would it be better to file a motion on my step daughter's behalf instead of "fighting" for custody? Is she considered old enough in the state of Georgia for us to do that?

13 year olds have no statuatory right to have any say-so in custody cases.
