Adoption

I have not seen or heard from my ex husband in almost five years. I divorced him through publication and have sole custody of my five year old son. I'm getting remarried and my fiance would like to know how we can go about having him adopt my son.

A stepparent adoption would seem to be applicable under Georgia law, based on the facts you have given. Your new husband can adopt the child if the father has failed to communicate with the child or pay child support for the child for over 12 months.
