Change of Jurisdiction

If the non-custodial parent (North Carolina) has filed (Virginia) to take me back to court, can I file to change jurisdiction to where the child and I curently live (Georgia)

If the original order was in Virginia and neither parent nor the child lives there anymore, then the case must be filed in the state where the child is now. You should see a lawyer about the facts of your case to be sure. You may need to hire a lawyer in Virginia to stop the action there and a lawyer in Georgia to defend against the case when it is moved here.

You asked me the same question in email, and under the additional facts that you emailed to me, no you cannot. If you had been here in Georgia longer, depending on the language of the Virginia order, the answer would be the one that the other lawyer here posted to you, but he was not aware from your question of the additional facts you emailed to me.
