Child Custody to the Grandparent

I live in Ga. My sister died last year and has 3 children. They all have different fathers, however, none of the fathers signed the birth certificate or paid child support. Our mother has the kids now but need to know how to legally gain custody or guardianship Or does the maternal grandparent automatically have rights to the children?

Assuming your sister did not have a will that stated what she wanted done with the children, the court will have to decide. And while the grandparents will not automatically get the children, they will probably be considered.
