If you have a child out of wedlock and you and the father are no longer together can you have your child lady name changed to the mothers maiden name the child is under 2

Did the father sign the acknowledgment of paternity form and legitimation provision at the hospital? It takes a court order to change a birth certificate. Unless the father has abandoned the child for the specified number of years, you have to get his consent.
