Legal Question in Family Law in Georgia

Confused step-mom

The biological mom of my step-child is threatening to ''ban'' me from all school functions, doctors appointments etc. (Bio-dad and bio-mom share joint physical custody). I know that I don't have any rights as a step-parent, but can she really do this?? It would devastate both me and my step-child if I can't go to his school activities. To clarify - I don't volunteer or anything - I just attend conferences with dad and go to school plays, concerts etc. On days that dad has to work later (past 5pm or so) I take step-child to doctor if has appointment - otherwise, bio-dad takes to dr.

Help!!??

You're reacting to a non-existant problem. Ignore hateful comments made in a domestic setting. Do not respond to them. Don't even think about them. In the highly unlikely event that a parent would be stupid enough to file a request like that in Court (many judges would question her fitness as a custodian if she did so without serious cause) you could address it then. Right now, no problem exists, and you can and should ignore the words.

I would agree with the other comment. Remarks like that are the adult equivalent of a 4 year old�s temper tantrum.

Technically, you, as step-mom have no rights. However, your husband certainly does. Unless you are unfit, your husband can file a petition asking the court to declare that he can designate who (i.e., you) can take care of the child.
