I am going to court because my grandson father is trying to take him away from me i want to know can he do that if he have an open case of false imprisonment and baterry ?

If you do not put a good defense he might be able to obtain custody.

Obtain an attorney, file an answer objecting to the motion, obtain court and police records regarding his charges, and plan a good defense with counsel.
