I am in a custody battle with the paternal grandmother but she recently passed away and my kis are with the grandfather but hes not biological grandfather what are my rights

The step grandfather is not a specified person to obtain custody. If he isn't part of the legal action at this juncture, assuming something has actually been filled, you need to file the appropriate motion to dismiss based on your grandmother being deceased. There may be some third party right to the grandfather, but you really need to speak with an attorney pronto to go over the pleadings and issues.
