Legal Question in Family Law in Georgia

Can I give my ex a time limit to get his personal items?

My ex husband left a yr ago and we have been divorced for 5 months now. In our agreement he is supposed to get all of his items out of our yard, storage shelters, and misc outside junk he has accumulated. My yard looks nasty and I am afraid my boys are going to get hurt on all this junk. He comes and gets things as he needs them. Legally can I give him a time limit to get all of his items he is supposed to get? Or is there a law that says these items legally become mine after so much time? I would really like for him to get this junk out of my yard! Thanks.

I would need to see the exact wording of the settlement agreement to give a good opinion. But, I would write him a certified letter giving him a couple of more weeks to get it out, pointing out the safety issues you noted, and stating that if he didn't you will file a contempt charge against him and ask the Judge for attorney's fees and court costs. I would not throw the stuff away as he might file a contempt action against you and you might end up paying him for the stuff he should have removed in the first place. There are personal property abandonment laws but they wouldn't apply here, since there's a contractual agreement and some discrepancy about what that agreement is.
