Legal Question in Family Law in Georgia

QUESTION: Would box marking the Domestic Relations Case Filing Information Sheet, aide me in seeking court assistance with a move time for spouse from the home. He authored as petitioner the divorce document and did not check violence box. What avenues of removal do I have.

BACKGROUND: I fIled an arrest warrant on spouse shortly, after police responded to a domestic violence assult call in middle May, still waiting the 14 Jul 16 hearing. Two weeks later spouse authored, we submitted a non-contested divorce complaint + MSA; with a divorce date set 6 Jul 16.

DELIMIA: He will not voluntarily leave the home without legal intervention after finalization of the divorce. I've been unsuccessful with removal at time of the domestic violence (assault) call. They tell me to leave, but I can't trust this person in my home unattended. What can I do to expedite the move upon divorce being granted.

You have screwed up badly. You do not have an uncontested case. Get a lawyer and file proper pretrial motions and pleadings at least 10 days before your hearing. Absent that it may be too late to fix the mess you have created thus far.
