What rights does a father have under FMLA for the birth of a child? Is he allowed to take FMLA to care for his child at home when he does not have a babysitter during the first 12 monthis after the childs birth? What type of documentation does he have to supply.

Assuming your employer is covered under the FMLA (generally, it must have at least 50 employees) and you have worked there long enough to qualify for FMLA benefits (at least 1250 hours over 12 consecutive months), the birth and care of a newborn child is a qualifying reason to take FMLA leave. The FMLA permits you take up to 12 weeks of UNPAID leave during a 12-month period. Your employer may require you to complete a form, but you shouldn't need any other documentation aside from perhaps the child's birth certificate.
