Legal Question in Civil Litigation in Georgia

How do we go about evicting a family member from our household? There is no lease agreement. The person in question was invited to stay with us but chose to become violent towards another person in the household and we need him to leave immediately. The police have not been helpful in this situation.

To evict anyone without a lease you must give 60 days notice. I'd recommend written notice. You can't just say "leave."

(In some cases, there may a second option - a TPO as a Family Violence case. Discuss that and an eviction with a lawyer).

Written notice on 1st of month - wait 60 days - if not moved out by then file disspossessory with magistrate court or, as Glen suggests, when it gets "ugly" file for a TRO (under FVA) to have Court force him/her out sooner
