Legal Question in Civil Litigation in Georgia

My Husband was involved in an auto accident 09/2014 and was told by the individual he would compensate him, but this never happen.

I went thru the person insurance and he denied it for I month and final came clean about the accident.

we are settling with the insurance company and they told my husband he cannot be compensated for medical since he did not go to a doctor even though my husband advise them he is still having back pain. Is that correct he cannot be compensated for medical claim?

Sincerely,

M.G.

It is not an issue of "correct" or not "correct." You are choosing to negotiate settlement, and they do not have to agree with what you are asking for. Certainly, the fact that your husband did not go to the doctor or seek treatment would be relevant. Your choice is to either reach an agreement with them or hire a lawyer to continue.

If you settle, they will have your husband sign off and all of his claims will be lost

You need to hire a lawyer and sue the driver if you are not happy with the settlement amount

Do not sign anything or speak with adjuster again if you want to hire a lawyer -- he can take over and bring your case before a jury (if it gets that far)

What insurance company??
