Legal Question in Civil Litigation in Georgia

Lawsuit!

I was being sued by my previous employer for relocation expense for not completing the terms of my relocation. After finding out about my lawsuit I contacted the corporate office and spoke to the VP of Operations. He told me that the lawsuit would be withdrawn if I made an intial payment and paid the balance over time. Since then I have made a large payment and still have a balance of about $1200 remaining. My question is, since the lawsuit was dismissed: 1) Can it be brought up again? 2)What happens if I choose not to pay the remaining amount? They don't have any written documentation outline repayment schedule or a signed contract. I have tried negotiating with them but they are ver spiteful about the situation. The remaining $1200 is really a financial burden on me right now so if I can avoid paying it then it would be great.

Thank you for your imput.

Re: Lawsuit!

Your post is a good example of why you need a lawyer before, rather, than after you do things. Unless the suit was dismissed WITH PREJUDICE, it can be refiled. And unless you have written documentation of your agreement, you may not be able to prove it. (You may also have had valid defenses to the suit).

Re: Lawsuit!

To add to the previous answer, even if you can't be sued for the original debt again (which is usually not the case), you may be sued for failing to comply with the settlement agreement.
