Legal Question in Civil Litigation in Georgia

Warrant Applications Hearing

Husband had affair that he ended. This female came to our house at 6:30am looking for me & her house key. Husband went to his truck, got key & gave it to her. She slapped him. He told her to leave & not come back. She kept following him to the house saying she wasn't leaving until she got to his wife. He stopped, turned, she drew back to hit him again. He grabbed her arm above elbow, turned her around & escorted her to her car. She was yelling profanites & blowing horn. She filed for warrant application for assault, saying he threw her to ground. No mention of her assaulting him first. She continued driving by our house for several hours. We filed police report of assault & the drive-bys.

She has tried more than 20 times to contact him. We have warrant application for harassment as well as many police reports on her. Her lawyer even called to find out if she was still calling & said he'd told her to stop & for us to keep records of all calls.

Son is a witness to hearing all of this that AM.

We have many police reports, tape of threats on phone, record of Sgt calling her & telling to quit calling.

Don't want husband to go to jail over this. Are we missing anything? (no lawyer hired)

Thank You.

Re: Warrant Applications Hearing

I'd suggest hiring a local criminal lawyer who can giude you through the steps of getting a restraining order. After so many complaints with no resolution, you need to take it a step further. As for Husband.... he can have a chance to defend any charges against him. I am not sure he will be a sympathetic person to a judge.

Re: Warrant Applications Hearing

You should ASAP consult with a local attorney about getting a restraining order. In the application, your husband can lay out all the facts of the history and at least be on record as to his contentions.
