Divorcing before getting green card

My wife and I gor married in November of 2002 in Hawaii and have a daughter together. Before we got married, she punched me on my face in front of her two daughters and also threw me her cell phone after we got married. On both occasions, I called 911 but no charge/case was filed. We both had houses prior to marriage and moved into my house when we got married. However, due to my lay-off from my job, we moved into her house. She has been telling me to get out of her house when we get into arguments. The situation is very stressful and I am trying to get out. How can I still get my green card when I file for divorce (since I file I-485 based on marriage) so I can be with my daughter?

Your only hope is a petition for battered spouse based on the abuse. A case of this sort is difficult but doable. Email with more questions or conerns at [email protected]
