Legal Question in Insurance Law in Georgia

Life Insurance Collection

Mom tried to collect money for a wrongful/accidental death. The insurance company denied the claim, stating that the problem was pre-existing: see below.

Cause of death was determined to be Arterial Scherosis, resulting in Cardiac dysrhythmia. The blocked arteries amounted to less than 10%. No previous medical records cited the disease, yet the insurance company claimed it was pre-existing. 2 months before he died, we were in an area that if there were heart problems, he would have had them then (around the grand canyon). The insurance company did not give mom enough time to work through both the funeral and the settlement, and so she settled for a lesser amount of cash than she would like (it wouldn't cover the funeral).I feel that mom was under a sort of duress because the company was not cooperating and she had a funeral to plan and related things to do. The time limit given was not long either.

Dad's death was June 5, 2002 and the insurance was Blue Cross Blue Shield.

How do we collect? Is there still a chance of winning?

Re: Life Insurance Collection

If your mother settled with the insurance company, the case is probably closed for good.
