Vehical Accident resulting in death of my Mother

The person that hit my mother in a head on collision has the lowest amount of insurance that Georgia allows. I think it was 25/50/25, does this mean that we are only intitled to 25,000? And who pays medical exspenses?...

Without a full picture there is no way to really answer you as to liability or what you can claim. I again suggest you call me and set up a time where I can review your case in depth at no charge.

It is possible that there may be sources of additional monies. When policy limits are exhausted, one can pursue the assets of the driver and/or owner of the vehicle for additional monies. Additionally, in some cases your mother's uninsured/underinsured motorists coverage may kick in. Also a person might happen to have an umbrella policy, or other at fault persons may also be insured.

In some cases, your mother's Medpay or other health insurance also will be paying bills.

YOU SHOULD NOT HAVE TALKED WITH THE INSURER ENOUGH TO KNOW THE POLICY LIMITS AND IT IS VERY IMPORTANT THAT YOU DON'T TALK WITH THEM EXCEPT THROUGH LEGAL COUNSEL. See a lawyer - be it me or someone else as soon as possible.

I am presuming you are the same person who submitted the previous question about your mother's tragic collision. The case needs to be thoroughly investigated before that question accurately can be answered but the short answer is "No." In addition to the information about UM given in my earlier answer, even if the defendant has minimum limits, if he has assets and a job you may still be able to get more than the liability limits but it probably will take winning a trial to do it.
