Legal Question in Landlord & Tenant Law in Georgia

my friend went to rent an apartment in georgia and put down earnest money. No lease agreement was ever signed. Well before my friend could move in, the apartment complex gave the apartment my friend put down earnest money on to someone and now they want him to take another apartment. After viewing the other apartment, my friend decided he doesn't like that apartment, because it's not the same floor plan. Now the landlord is refusing to return his earnest money.... Is this legal and what should my friend do?

Certainly, your friend didn't pay a deposit without an agreement as to when and when it is not refundable. He should have already read that document. His answer is there. We've never read it, so we don't know. He does know.
