Legal Question in Landlord & Tenant Law in Georgia

I had good intentions on leasing an apartment but changed my mind. I went to the leasing office late in the evening before they were about to close and left a check for the apartment deposit (which I was told would be refunded if I did not qualify for the apartment) but took the application with me to fill out. Upon my return I was to bring back the application along with the application fee. I went to the rental office on saturday and notified them on Friday of my intent not to lease. Can they take the application deposit without my signed appplication?

It depends on the terms of the deposit - was it refundable upon your decision not to rent? Most deposits like that are there to hold the apartment, and if you back out, the landlord gets to retain it.
