Legal Question in Landlord & Tenant Law in Georgia

Landlord selling property

My landlord is selling the house I rent. I do not have a lease. Yesterday, Sept 18, 2003, he informed me that we must be moved by October 15, 2003. I am not sure that I can relocate my family in this time period. What are my legal rights? Can he evict me on October 15?

Re: Landlord selling property

No, he can't. When you have no lease Georgia Law applies, he must give you 60 days notice, you must give hime 30 days notice.

Re: Landlord selling property

I concur that he must give you 60 days notice if you are a month to month tenant without a lease. In fact, when he goes to the court to file his affidavit of eviction, he will have to state that he gave you a proper 60 day notice or the court should not issue the summons for the hearing. However, if you can be out by 10/15/03, this could be an opportunity for you to bargain for money. If he is in a desperate hurry to sell, you may be able to get him to pay you to get gone. If he sticks to his guns, feel free to contact me at [email protected].
