Is our rent to own lease agreement says that we have 10 days before a late charge is to be paid can they change it to 5 days and increase the amount without a new lease?

The terms of a lease cannot be changed during the terms of the lease without an agreement between you and the landlord to do so, unless there is a provision in the lease which allows them to change it (which would be very unusual). However, if your lease term is up, and you have not signed a new lease, you are an at will tenant and they can make the terms whatever they want them to be. In such case, your only recourse would be to sign a new lease, abide by whatever terms they set, or move out after giving 30 days notice.
