Legal Question in Medical Malpractice in Georgia

Had back surgery in Dec. 2010. Recent pain and numbness in hip and leg that required x rays and myelogram showed 2 broken and 1 loose screw. ( I have a total of 4 screws) Dr. said he could not tell me the next step until he talked to the manufacturer of the hardware. (he was I assume the Dr. id s protecting himself by asking their advice. Dr. said he had never seen this so I must assume he has never removed hardware before. I'm sure I need medical and legal advice in order to be treated fairly. I don't know where to go with this.

You may or may not technically have a case against your doctor and/or the manufacturer of the hardware. You only have a case against your doctor if your treatment fell below the standard of care in the medical community. There are also elements that must be satisfied to pursue any case against the manufacturer. But the bigger problem is that these cases are very costly, in terms of both time and money, for any lawyer to pursue. So normally you can only find a lawyer willing to take your case on a contingency, where they advance litigation costs for you, if your injuries are very severe. The only way to know for sure is to call several medical malpractice and product liability lawyers, and ask them if they would consider accepting your case. You shouldn't try to do this alone. And you should act quickly, as all cases involve important deadlines that cannot be missed.
