Legal Question in Medical Malpractice in Georgia

Breast Implants

I posted the other day but I think it was in the wrong catagory because I didnt get any responses. I hope I get some this time. My boyfriend paid for a breast lift surgery and also implants. The lift went good but my boobs are not as big as I wanted them to be. Also the arolas are (the middle dark part) still too big. I asked my surgeon to get them to the size of a quarter coin and they are still bigger more like a half dollar coin. My doctor said he could make them smaller like a quarter coin but they are not. I do not like the way my boobs turned out and my boyfriend dont either. He says that I have to pay him back for the surgery because they are not big enough. I am upset because my boobs are still too small to with great big arolas and I am afraid my boyfriend might move out because of this. I dont want to lose my boyfriend. The doctor did not make my boobs look like I asked him to before the surgery. Can I sue for malpractice because the surgery did not go right? Also, can my boyfriend make me pay him back for my boobs? He says he can and that it is legal since he also didnt get what he asked for. Please help. Thank you .

From what you described, it does not sound as if the physician committed malpractice with respect to your breast augmentation surgery. On another note, if your boyfriend paid for your surgery and did not have any agreement in writing it will be difficult for him to prove that his financial assistance was not a gift. Especially since it appears that he had a significant interest in the aesthetics of your breast and would directly benefit from the procedure as well.
