Legal Question in Medical Malpractice in Georgia

The client was 14 years old when a hydrocele was performed. The client had Medicaid at this time, which paid for the procedure. After the procedure the client had testicular pain, but never told his parents. The client is now 20, and has no insurance. The client has described the pain as severe, similar to the pain before the hydrocele. The family is wondering if the doctor or hospital can be held liable for the pain and for a procedure to repair the damages. Or, if Medicaid would pay for it since the damages occurred during a time when the client had Medicaid.

I can guarantee that Medicaid would not go back and pay it now. However, there may be a malpractice claim if you are still within the Statute of Limitations. Limitations for minors are extended for a period of time after they turn 18, so you would need to get in to see an attorney asap to determine whether this window has closed or not.
