Legal Question in Personal Injury in Georgia

My dad died from mesothelioma in 2009, in the state of Georgia. Where the law says if there is no will the property is divided what I understand is his current wife gets half and his half is divided amongst his heirs. He received a large settlement just prior to his death. He owned misc items cars, truck, jewelry and personal items, no home. My question is how do they structure the settlements in these cases are future payments considered part of his estate or soul property of the widow. My brother and I live in California ,so we had the court assign a administrator.

I would need more info in order to properly guide you. I'm a bit confused as to whether there was a structured settlement prior to his death or whether you are asking about some type of structured situation after his death. Please feel free to call me or email me.

I forgot to add that it is not necessarily true that the wife gets half. In fact, if there are two or more children the wife only gets one-third.
