Legal Question in Personal Injury in Georgia

Danages after entry of Default Judgement on Liability

My car was in an accident on November 5, 2002. My daughter was driving and was hit from behind at a stop light in front of Peachtree Mall - Columbus. The insurer had insurance with Southern General. This insurance company sent our car to a body shop by the name of Columbus Auto Group Body Shop. The body shop kept the car for 3 months. Later, after getting the car we found out that the body shop did not complete the repairs as stated on the agreement. In fact they put our lives in danager by leaving repairs undone on the car. The findings were documented and the results were that the repairs were unrepaired to the frame and unibody, rearenergy aborber, reinforcement beam and left a hole in the trunk were carbon monoxide gas came into the passenger section of the vichicle. We had an attorney who sued the insurance company for my daughters medical, however, we have relinquished him from the case. The Judgement against the body shop has run into some strange complications. I have completed some investigations on my own . The Columbus Group Auto Body shop, changed the name of the company, however, they are the same people, they paid their taxes on this property in the same name. I need someone to help us. Thanks JWH

Re: Danages after entry of Default Judgement on Liability

You have two separate cases - one against the insurance company for the accident and one against the repair shop for the failed repairs. However, you should include the insurance company in the complaint against the body shop because they sent your car there. I'm not sure what complications there are, but you need to file a suit and you then determine the real name of the company after the fact by suing ABC Company d/b/a "_________" and conducting discovery to get information on the company.
