Legal Question in Personal Injury in Georgia

My daughter was injured on a ride at whitewater. First we were given a card of the 3rd party who pays all medical bills and told to send them there. Now we've been told that since whitewater only has liability insurance, we must pay all of her medical expenses ourselves and then send them to the 3rd party for reimbursement. I have never heard of such, have you?

Sure we've heard of it but what is your legal question? WW (maybe given their past) has insurance that would appear to pay for injuries no questions asked. Otherwise, you would have to prove liability and negligence on their part, and show why you did not assume the risk of injuries when entering the park... and pay for all medical expenses yourself.

The real issue is how serious are your daughter's injuries? If the injuries are serious you really need to hire a lawyer and let him/her sort through all this. If the injuries are minor and you have health insurance, let your health insurance pay for the bills. If you have no health insurance, White Water has "Med-Pay" coverage that is supposed to pay regardless of fault for injuries sustained by a guest at the park. That is what you apparently were told at first and I believe that is still true, regardless of what someone is now telling you. Again, that is something a lawyer can get straightened out for you. Hire a lawyer ASAP, don't talk to any liability adjusters for White Water's insurer and be sure not to sign anything.
