Legal Question in Personal Injury in Georgia

Last night I backed into my coworker's car in a Steak N Shake parking lot. (We were going to park, there was an idiot driver in front of me, he did something stupid, I put my car in reverse, and she was close enough behind me that I hit her & she'll need a new hood.) She didn't take my insurance info (because I'm not insured on the car I was driving) & the only thing she got was my #. When she went home she told her parents that the accident happened at Chick-fil-A, not Steak N Shake. No police report was filed. But her parents are trying to get my parents' #'s & I have not given them to them yet.

The only reason I was driving and not insured on that car is because my car was getting fixed yesterday...

What is the legality of all this? Who's "fault" would this be?

What did you not understand about the response you got the first time? Stop the immature name calling and excuses and act like a responsible person. You parents will find out and it'll be worse for you. As far as who was at fault, YOU backed into someone.

With respect to the property damage, you are responsible. Unfortunately for your coworker, you likely do not have assets available to pay for the damages you caused. Ergo, she might obtain a judgment against you and sit on it for a number of years until you develop assets or she may simply file a garnishment once she obtains a judgement and she could take a portion of you income until the judgment is satisfied.

With respect to the potential personal injury claim, your coworker will likely be barred from suing you by virtue of Georgia's Workers Compensation Laws.

Lastly, with respect to the issue of you driving without insurance, my guess is that if a police report is created after the fact, you will receive a citation and you will have to pay a significant fine for your failure to follow the law. If she does not press the issue, consider this a valuable life lesson to help you make better decisions in the future.
